Terms of use

These Terms govern the PlantOn website, applications and digital platform services.

1. Platform operator and scope

PlantOn is operated by PlantOn j.d.o.o. za računalno programiranje, Matije Gupca 74, 31300 Beli Manastir, Croatia, VAT/OIB 16675597658, company registration number (MBS) 030255445, registered with the Commercial Court in Osijek ("PlantOn", "we"). These Terms apply to website visitors, registered customers and agricultural producers or family farms using PlantOn. By using the platform, you confirm that you have read and accepted these Terms. If you use PlantOn for a legal entity or farm, you confirm that you are authorised to accept them on its behalf.

2. What PlantOn provides

PlantOn provides digital infrastructure for presenting gardens and agricultural services, sending requests, communication, garden, activity and harvest records and, where available, notifications, photos, weather data and AI-assisted features. PlantOn is not the agricultural producer, owner of the offered land, seller of agricultural produce, delivery service, bank or accounting provider for a producer unless expressly stated otherwise for a particular service.

3. The producer's role and customer contract

The producer listed with an offer independently supplies and is responsible for the actual agricultural service. The producer determines the garden description and availability, reservation price and duration, planting and growing prices, harvest model, produce prices, payment terms, invoicing and pickup or delivery options and prices. An item may be charged separately, included in another item, offered at no additional charge or unavailable, as stated in the particular offer. A reservation and growing arrangement, produce purchase or delivery agreement is formed between the customer and the producer after the producer accepts the enquiry and the stated conditions are met. Producer details and offer-specific terms should be shown before final confirmation. PlantOn is not a party to that agreement but may provide technical support and facilitate communication.

4. Accounts, age and security

You must be at least 18 and legally capable of entering contracts to use payment-related features or conclude contracts. Minors may use informational parts only under a parent or guardian's supervision. Registration details must be accurate and current. You are responsible for protecting credentials and devices and for activity on your account. Notify us promptly at info@planton.me if you suspect unauthorised access. We may reasonably verify identity, authority or producer status for security and fraud prevention.

5. Enquiry, acceptance and reservation confirmation

Submitting an enquiry is not a confirmed reservation or automatic start of growing. The producer checks availability and may accept or reject it. Reservation confirmation occurs only after acceptance, agreement on essential terms and, where applicable, recorded payment. Listings clearly marked as informational, sample or demo content are not real offers to contract. Photos and visualisations may be illustrative; the description, price and terms of the particular active offer prevail.

6. Prices, payments and invoices

Prices are shown in euro and include applicable taxes unless clearly stated otherwise. Customers generally pay the producer directly for garden services, produce or delivery according to the producer's instructions. PlantOn currently charges no commission and does not receive funds on the producer's behalf unless the interface expressly says otherwise for a particular transaction. The producer is responsible for lawful pricing, payment information and invoicing. The customer is responsible for timely payment. Proof of payment uploaded to the platform is used for records and verification but does not mean PlantOn received or confirmed the funds.

7. PlantOn producer plans

Producers may purchase an annual PlantOn plan for business use: Basic for up to 10 active gardens at €180 per year, Premium for up to 20 active gardens at €300 per year, or Business with unlimited active gardens at €600 per year. Applicable taxes and the final amount are shown before purchase. Where enabled, Paddle processes payment as a separate payment provider and merchant of record. Subscriptions renew under the displayed terms until cancelled and cancellation generally takes effect at the end of the paid period. Plan changes and any prorated charge are shown before confirmation. Mandatory statutory rights remain unaffected; a producer buying for business purposes will generally not act as a consumer.

8. Nature of cultivation and harvest

Agriculture depends on weather, soil, disease, pests and other conditions that cannot be fully controlled. Growth estimates, harvest dates, quantities and images do not guarantee a particular yield, quality or date unless the producer expressly commits otherwise in the offer. The offer must state whether all available harvest belongs to the customer without an additional quantity charge or whether produce is charged by the quantity the customer chooses to collect. The customer does not have to collect the entire available quantity. The uncollected part remains available to the producer under the offer terms. Under quantity-based charging, the exact amount arises only after harvest, entry of the actual quantity and the customer's selection. The producer must act professionally, carefully and lawfully and promptly inform the customer of material changes. This does not limit liability for intent, gross negligence, fraud, breach of an express guarantee or rights that cannot legally be excluded.

9. Pickup, delivery and perishable produce

Pickup or delivery method, place, timing and price are governed by the offer and agreement with the producer. Customers must provide accurate delivery details and be available to receive items. Risk of deterioration caused by an unjustified customer delay is governed by the producer agreement and applicable law. Statutory exceptions to withdrawal may apply to perishable goods, goods prepared or harvested to customer specifications and fully performed services. Before contracting, the producer must clearly give consumers the required information on whether and how withdrawal rights apply.

10. User content, photos and communication

You retain rights in text, photos and other content you submit. You grant PlantOn a non-exclusive, royalty-free and worldwide licence to store, technically process, display and transmit it only as needed to provide, secure and improve the contracted service. You may submit only content you have the right to use and that does not violate privacy, copyright or law. Do not upload images of people without an appropriate basis. PlantOn may remove clearly unlawful, unsafe or inappropriate content and restrict access to protect users and the platform. Private messages are available to participants and authorised personnel where necessary for support, security or legal obligations.

11. AI, weather data and automated features

AI analyses, recommendations, summaries and weather data are assistive and informational. They may be incomplete, inaccurate or outdated and do not replace inspection by the producer, an agronomist, physician or other professional. Do not use them as the sole basis for decisions that may harm people, crops, property or the environment. PlantOn does not make decisions producing legal or similarly significant effects solely through automated processing. People make final decisions about cultivation, request acceptance and service delivery.

12. Prohibited use

You must not use PlantOn unlawfully or fraudulently; impersonate others; introduce malicious code; disrupt security or operation; access accounts or data without authority; scrape data without written permission; bypass restrictions; harass users; post unlawful or harmful content; or infringe third-party rights. We may temporarily restrict or terminate access where reasonably necessary to prevent harm, investigate a breach, comply with law or protect users. Where circumstances allow, we will explain the reason and provide a way to object.

13. Intellectual property

The software, design, databases, PlantOn name, logos and non-user content are protected by intellectual property law. You receive a limited, revocable, non-transferable and non-exclusive right to use the platform for its intended purpose while complying with these Terms. You may not copy, sell, license, decompile or create derivative works from the platform except where such restriction is not permitted by law or we have given prior written permission.

14. Availability, changes and PlantOn liability

We aim to operate PlantOn securely and reliably but do not guarantee uninterrupted availability. We may maintain, change or temporarily restrict the platform. Where possible, users will receive reasonable notice of material changes that adversely affect a paid service. PlantOn is responsible for its own digital service under applicable law. It is not responsible for acts or omissions of an independent producer, cultivation quality, harvest or delivery, or interruptions outside PlantOn's reasonable control. Nothing excludes liability that cannot legally be excluded, including intent or gross negligence, or limits mandatory consumer rights.

15. Account cancellation and termination

You may stop using the account at any time and request deletion through available settings or at info@planton.me. Account deletion does not automatically terminate a live producer contract or erase records that must be retained by law. See the Privacy Policy for details. We may terminate an account for serious or repeated breach, non-payment, fraud, security risk or legal obligation. Where reasonable and permitted, we will first provide notice and time to remedy the breach.

16. Consumer complaints and disputes

Written complaints about PlantOn's digital service may be sent to info@planton.me or PlantOn j.d.o.o., Matije Gupca 74, 31300 Beli Manastir, Croatia. Include your name, contact details, issue and relevant request or transaction number. We will acknowledge and answer in writing within 15 days, clearly stating whether the complaint is accepted. Complaints about cultivation, produce, producer invoices or delivery should first go to the producer acting as trader for that service. PlantOn may help forward the message but does not assume the producer's obligations. Croatian law governs these Terms. Croatian courts have jurisdiction, without depriving consumers of mandatory protections or their right to bring proceedings in the competent court of their residence. We encourage amicable resolution and available alternative consumer dispute procedures before litigation.

17. Changes and contact

We may update these Terms for changes in features, business model or law. The latest update date appears at the top. Where required, registered users will receive appropriate advance notice of material changes affecting an existing contractual relationship. Continued use after changes take effect constitutes acceptance unless express consent is required by law. Questions about these Terms may be sent to info@planton.me.
